    Under Texas law, the foreclosure process does depend a lot on the way the mortgage is written. If the loan documents do not have a power of sale clause, a judge will oversee the process.

    For homeowners that have a sales clause, the process is fairly straightforward. Once a home is deemed in default, which is generally after three to six months of non-payment, the lender will demand payment of the past due amount. Homeowners have 20 days to bring the account up to date or face foreclosure. If this timeframe expires, a notice of sale will be recorded with the county clerk where the home is located. A sale will then take place.
